Donald Trump, the U.S. president, said on Friday he has signed an immigration proclamation, an order that would help effectively ban migrants who cross the USA border with Mexico illegally from qualifying for asylum.

"We need people in our country but they have to come in legally and they have to have merit", Trump told reporters on Friday, before departing for Paris.

"The new measures adopted today by the U.S. Department of Homeland Security and Department of Justice, under the orders of President Trump, barring those entering the United States between ports of entry from applying for asylum, are a direct violation of Article 31 (1) of the United Nations Refugee Convention, to which the United States is bound", said Kathryn Hampton, program officer for Physicians for Human Rights, in a statement. "It is illegal to circumvent that by agency or presidential decree", said Omar Jadwat of the American Civil Liberties Union.

The White House announced Thursday that it will crack down on "meritless" claims of asylum by illegal immigrants attempting to cross the border.

Many of these immigrants in the past have sought asylum citing a "credible fear" of harm having already committed other offenses, such as entering the country illegally.

U.S. Customs and Border Protection officials defend the practice on the grounds that the border crossings are not equipped to process hundreds of asylum seekers daily, and officers must continue to facilitate ordinary cross-border travel and trade while protecting the country from terrorists and drug runners.

The regulation would "channel inadmissible aliens to ports of entry, where they would be processed in a controlled, orderly, and lawful manner", according to the statement.

Immigrant advocates have denounced the move, saying it violated existing United States law that allows people fleeing persecution and violence in their home countries to apply for asylum regardless of whether they enter illegally or not.

"U.S. law specifically allows individuals to apply for asylum whether or not they are at a port of entry".

Slate reported on November 5 that Kavanaugh has declined to "run interference" for Trump in three of his early rulings - when he declined to rule on the controversial citizenship question on the 2020 Census; when he did not publicly share his vote on the deposition of former commerce secretary Wilbur Ross and stayed mum on the court's decision to punt the legality of the citizenship question to a circuit court.

The new restrictions are expected to be challenged in court. Claims have spiked in recent years, and there is a backlog of more than 800,000 cases pending in immigration court.

In 2017, the US fielded more than 330,000 asylum claims, almost double the number two years earlier and surpassing Germany as highest in the world.
