A three-judge U.S. Court of Appeals panel in Washington on Thursday denied the former Trump campaign chairman's bid for freedom, saying he'd not shown them that his request should be granted before they rule on his underlying challenge.
"Among the unique privileges Manafort enjoys at the jail are a private, self-contained living unit, which is larger than other inmates' units, his own bathroom and shower facility, his own personal telephone, and his own workspace to prepare for trial", the prosecutors wrote. While Manafort was not required to wear a jail-issued uniform at Northern Neck Regional Jail where he was being housed until Thursday morning, Bertsch says all inmates at the jail in Alexandria are required to wear the dark green jail jumpsuits used at that facility. Specifically, Manafort was charged with multiple counts relating to money laundering and bank fraud. On Tuesday, he ordered that Manafort be transferred to a jail in Alexandria, about 20 minutes from Washington, "to ensure that defendant has access to his counsel and can adequately prepare his defense".
The special counsel's lawyers reported that the jail in Warsaw doesn't allow prisoners to send emails but that Manafort "appears to have developed a workaround" by reading and drafting messages on a second laptop that's brought in and out of the jail by his legal team.
As for listening in on Manafort's phone calls, Nanavati wrote: "Armed with personal conversations between Mr. Manafort and his family, the special counsel selects snippets to support its version of events". He was ordered to jail ahead of his trial after prosecutors accused him of contacting witnesses to influence their testimony.
Though Manafort's lawyers have said he spends almost all of his days in solitary confinement, prosecutors described his living arrangements as a "private, self-contained living unit, which is larger than other inmates' units" with its own bathroom and shower.
But Manafort's lawyers, in a motion that sought to delay his July 25 trial, argued in part that they had to travel 100 miles to meet with their client.
"Defendant's access to counsel and his ability to prepare for trial trumps his personal comfort", Ellis said.
Manafort's house arrest was revoked last month amid witness tampering allegations and he was booked into the Northern Neck Regional Jail in Warsaw, Va.
In recent phone calls, they say, Manafort also has said he has "all my files like I would at home" and has "gone through all the discovery now". "When the team takes the laptop from the jail, it reconnects to the internet and Manafort's emails are transmitted", the prosecutors said.
They also recently provided Manafort with 8,290 documents from the computer of his former business partner, Rick Gates, who has pleaded guilty and is cooperating with the prosecution.
"Manafort can hardly now complain about the order of the trials", the special counsel's attorneys said.
