Apple and Samsung Terminate Smartphone Patent Disagreements

Apple and Samsung have ended a years-long patent battle over copied iPhone design with an undisclosed settlement, according to a U.S. court filing today.
Samsung was given the $539 million penalty in May as it was found infringing on five patents with Android phones it sold in 2010 and 2011.
Apple and Samsung have been fighting a patent infringement legal battle for seven years after the latter was accused of copying the iPhone design and software features. For the companies, the long-running battle was about more than money.
Samsung did not immediately return a request for comment.
In May, a USA jury awarded Apple US$539 million, after Samsung had previously paid Apple US$399 million to compensate for patent infringement - Samsung would need to make an additional payment to Apple of almost US$140 million if the verdict was upheld. Samsung was ordered to pay $1.05 billion in damages by jurors in 2012, which was reduced on appeal to $930 million.
Part of that money had already been paid to Apple before a Supreme Court ruling on how damages were calculated, as was a Dollars 119.6 million verdict against Samsung that was upheld on appeal. The companies did not reveal the settlement amount.
"We believe deeply in the value of design", Apple said recently, "and our teams work tirelessly to create innovative products that delight our customers".
In June, Samsung filed a motion with the US District Court in San Jose to appeal a verdict that asked the South Korean giant to pay Apple $539 million for copying patented iPhone designs.
The three design patents in the case apply to the shape of the iPhone's black screen with rounded edges and a bezel, and the rows of colourful icons displayed.
"This dispute raised some important issues and contributed to the evolution of patent case law", said Florian Mueller, a noted intellectual property activist who has covered the event from the start, "but the part related to design patents was going in circles".
Neither Samsung nor Apple clarified what the terms of the settlement were.
