Judge refuses to dismiss ex-Trump aide Manafort's criminal case

U.S. District Judge Amy Jackson on Tuesday denied President Donald Trump's one-time campaign chairman Paul Manafort in his request to dismiss the charges brought against him by the special counsel.

In a sharp rebuke of those claims, judge Amy Berman Jackson of United States district court for the District of Columbia ruled that deputy attorney general Rod Rosenstein had followed all the justice department's rules when he hired Mr Mueller and the case against Mr Manafort is not overly broad or improper.

Referring to Mueller's appointment order, she said that the charges fell "squarely within that portion of the authority granted to the Special Counsel that Manafort finds unobjectionable: the order to investigate 'any links and/or coordination between the Russian government and individuals associated with the campaign.' (Manafort had also challenged the provision of the appointment order that said that Mueller could investigate matters "that arose or may arise directly" from the probe)". In Virginia, he faces charges that include bank fraud and filing false tax returns. Berman Jackson wrote. "Given the combination of his prominence within the campaign and his ties to Ukrainian officials supported by and operating out of Russia, as well as to Russian oligarchs, Manafort was an obvious person of interest".

"It bears emphasizing at this stage that Manafort is presumed to be innocent of these charges, and it will be the prosecution's burden to prove him guilty beyond a reasonable doubt".

Third, Acting Attorney General Rod Rosenstein had broad authority to "authorize the Special Counsel to investigate not only 'links and/or coordination, ' but also, 'any matters that arose or may arise directly from the investigation.'" So even if the charges against Manafort were not sufficiently tied to Russian Federation, they could still potentially proceed under the remainder of the powers delegated to Mueller.

Judge Jackson was not moved by any of Mr Manafort's assertions.

Republicans in the House of Representatives who are critical of the probe have pressed the justice department in recent months to provide them with an unredacted copy of the August memo.

In response to these charges, Manafort claimed that he could not be prosecuted by Special Counsel Robert Mueller because the particular charges against him are outside of Mueller's properly delegated authority.

That judge, T.S. Ellis, said he believed prosecutors were using the charges against Manafort to try to get him to turn against Trump.
