Justice Department sues California over federal land sales

  • US Justice Department to Sue California Over State's Right to Sell Lands

"We are forced to spend our resources to bring these lawsuits against states like California that believe they are above the law and are passing facially unconstitutional laws specifically meant to interfere with the federal government's ability to carry out its legitimate law enforcement duties", Attorney General Jeff Sessions said in a statement.

Eighteen state attorneys general and six cities sued the Census Bureau and the Commerce Department Tuesday over the Trump administration's plan to add a citizenship question to the 2020 count of the nation's population.

The law, known as SB 50, purports to prevent county and state employees from recording the transfers of deed of federal public land unless a California commission is given a "right of first refusal" to arrange the transfer to its own chosen entity, presumably the state itself. At the time, California officials said the bill was necessary because of fears President Trump would permit drilling or development on the roughly 46 million acres of land in California owned by the federal government.

California state Sen. Ben Allen, who authored the legislation, told The Washington Post the law was "very carefully crafted" and meant to ensure the state would have the chance to intervene if the federal government sought to sell land worthy of conservation.

California Attorney General Xavier Becerra said in a statement that the state's public lands shouldn't be on the auction block to the highest bidder. "We hope the Trump administration turns away from misguided and unpopular land giveaways".

But Acting Deputy Attorney General Jesse Panuccio told reporters Monday, the law is "another example of California avoiding federal law, and no state legislature can, statute by statute, undermine the rule of law and the U.S. Constitution".

Environmentalists in the state are incensed over a previous presidential order directing the Bureau of Land Management to consider changes to protections for the state's deserts.

California Gov. Jerry Brown called the move a "belated April Fools' Day trick".

The Trump administration on Monday signaled that it will likely upend California's ability to impose stricter standards for vehicle emissions than the rest of the country.

The administration in early March announced it would challenge the state's so-called sanctuary policies, restricting local law enforcement's communication with federal immigration authorities.

"I regret the need to file yet another lawsuit against the state of California today", Sessions said in a statement.
