  • Adnan Syed will get a new trial over the 1999 murder of his ex-girlfriend

On Thursday (local time), the Maryland Court of Special Appeals upheld the ruling, granting Syed a new trial.

Syed was accused and convicted in 2000 of burying Lee's body in in a shallow grave in a Baltimore park.

The state appealed the 2016 order, leading to Thursday's decision by the court of special appeals - Maryland's second highest court.

Classmate Asia McClain allegedly saw Syed in their high school library during the time prosecutors said Lee was murdered.

Thursday's decision is a result of a 2016 ruling in which a judge vacated Syed's 2000 conviction.

The ruling can still be heard in the Court of Appeals.

The Maryland Court of Special Appeals found that Syed had ineffective assistance at his trial and ordered his convictions vacated in the murder of his former girlfriend Hae Min Lee.

Syed maintained his innocence, and in 2014 his case attracted worldwide attention when it was featured on the "Serial" podcast, which was downloaded millions of times and prompted legions of listeners to scrutinize the case online.

In the meantime, Syed's current attorney, Justin Brown, has celebrated the decision, tweeting in all-caps: "WE WON THE APPEAL". The show attracted millions of listeners and shattered podcast records. "The instant case will be remanded for a new trial on all charges against Syed".

In its opinion Thursday, the three-judge panel affirmed that the defense team's "deficient performance prejudiced Syed's defense", explaining that his counsel failed to contact a potential witness whose alibi could "have raised a reasonable doubt in the mind of at least one juror".

"How can you possibly evaluate an alibi witness without speaking to her?" Maryland Attorney General Brian Frosh's office said it is "currently reviewing today's decision to determine next steps", according to The Baltimore Sun. "We're ready to try the case", Brown said. Further information regarding Syed's retrial, including a court date, has not been released.
